1. Scope
These terms of use apply to your use of the "wiegemichnicht" app operated by Carsten Fregin (spielgestalt), Pracherdamm 106, 25436 Tornesch, Germany (see Impressum for contact details).
If you obtain the app through Apple's App Store, Apple's standard license agreement for apps (Licensed Application End User License Agreement) applies in addition; if you obtain it through Google Play, the Google Play Terms of Service apply in addition. As between you and us, these terms of use prevail.
2. Description of the service
The app helps you log meals, activities, and body weight, and calculates a calorie target. Calorie and nutrient values for photos or text descriptions are produced using an AI estimate (Google Gemini) and may differ from actual values.
3. Free use and "wiegemichnicht Plus"
The app can be used free of charge. Calorie estimates by photo, text, for activities or when importing a recipe are limited to a number per day (currently 3). Without Plus, the history and the weight chart show the last 30 days; your diary and all your entries remain complete and accessible.
With the paid subscription "wiegemichnicht Plus" you additionally get: a higher number of estimates per day (currently 20, as a fair-use limit), recipe import via link, your own macro goals, an eating rhythm (a daily eating window in the sense of intermittent fasting, or fasting days with a reduced calorie goal), the "Nutrition" section (food groups, vitamins, and minerals), the full history, the weight forecast, importing your body fat percentage from Apple Health or Health Connect or entering it by hand when you weigh in, each with a target body fat percentage, automatic logging of meals and weight to Apple Health or Health Connect, on iPhone and iPad, importing new data from Apple Health even while the app is closed, and logging meals and weight right from the Apple Watch. The app shows which features Plus includes before you buy.
We may extend the features included in Plus at any time. We may reduce them only for a valid reason, namely if the costs or conditions of the third-party services we use (in particular for calorie estimation) change materially, if a feature can no longer be offered for legal or technical reasons, or to prevent abuse; this will not cause you any additional cost. We will inform you of a reduction at least 30 days in advance in the app and by email to the address of your account. For your running subscription it takes effect no earlier than the next renewal. If the change impairs your use of Plus more than insignificantly, you may end the subscription free of charge within 30 days of receiving the information (Section 327r of the German Civil Code, BGB); you can cancel at any time anyway (section 5).
Data export and deleting your account are always free of charge.
4. Purchase, price, and payment
You buy Plus in the app through Apple's App Store (iPhone, iPad) or through Google Play (Android). Apple or Google is the contracting party for the purchase and payment; Apple's terms for App Store purchases or the Google Play Terms of Service apply in addition. The price is shown in the app and in Apple's or Google's purchase dialog before you buy and includes statutory VAT. Payment is charged to your Apple Account or your Google account.
5. Term, renewal, and cancellation
Plus is available with a monthly or yearly term. The subscription renews automatically for the selected term unless you cancel it at least 24 hours before it ends. You can cancel at any time in your Apple Account settings (Subscriptions) or in Google Play under "Payments & subscriptions", or via "Manage subscription" in the app; Plus stays active until the end of the paid term.
Deleting your account in the app does not cancel a running subscription. Cancel it first in your Apple Account settings or in Google Play.
6. Free trial
A free trial may be offered for the yearly subscription (currently 7 days). The trial can be used only once per Apple Account or Google account. Unless you cancel at least 24 hours before it ends, it automatically converts into the paid yearly subscription and the price is charged to your Apple Account or Google account.
7. Withdrawal and refunds
Because the purchase is made through Apple or Google, withdrawal and refunds are governed by Apple's or Google's terms. You can request a refund at reportaproblem.apple.com or through Google Play Help (support.google.com/googleplay). Your statutory rights as a consumer remain unaffected.
8. Price changes
Apple or Google notifies you in advance of price changes for running subscriptions. Where Apple or Google requires your consent, the new price only applies once you have agreed; otherwise the subscription ends at the end of the current term.
9. Not medical advice
The app does not replace medical, nutritional, or psychological advice. The calculated values (basal metabolic rate, calorie target, timeline estimates) are rough guidance based on general rules of thumb (including the Mifflin-St-Jeor formula) and do not account for individual medical circumstances. The app shows which formulas and reference values it uses, and their sources, under Profile → Sources.
Talk to a doctor before changing your diet or starting a weight-loss effort, especially if you have a pre-existing condition, are pregnant, or have (or are prone to) an eating disorder. The app is not designed for use by people with a diagnosed eating disorder. This applies in particular to the eating rhythm (eating window, fasting days): fasting is not suitable for everyone, for example not during pregnancy or breastfeeding, with insulin-treated diabetes, with eating disorders or with a low body weight. The app does not assess whether an eating rhythm is right for you; that decision and the responsibility for it are yours. The same applies to macro goals with very few carbohydrates (ketogenic diet): the app points out deviations from general recommendations, but does not assess whether such a split is suitable for you.
10. Account and minimum age
Using the app requires an account. You are responsible for keeping your credentials confidential. The app may only be used from the age of 18.
11. Your content
You are responsible for photos, text, and other content you upload. Do not upload content you don't hold rights to, or that infringes the rights of third parties.
12. Availability
The app is operated with reasonable care, but no entitlement to continuous availability exists. Individual features (in particular the AI estimate) depend on third-party providers and may be temporarily limited.
13. Liability
We are liable without limitation for intent and gross negligence, for damage to life, body or health, under the German Product Liability Act, and to the extent of a guarantee we have given. In cases of simple negligence we are liable only for the breach of a material contractual obligation, i.e. an obligation whose fulfilment is essential for the proper performance of the contract and on whose observance you may regularly rely; in that case liability is limited to the foreseeable damage typical for this type of contract. Any further liability is excluded.
14. Termination / account deletion
You can have your account deleted at any time via the app (Profile → Delete account) or by email; use of the app ends immediately. For a running subscription, section 5 applies.
15. Changes
For material changes to these terms, you will be asked for renewed consent.
16. Governing law
German law applies. Mandatory consumer-protection provisions of your habitual residence remain unaffected.
