1. Scope
These terms of use apply to your use of the "wiegemichnicht" app operated by Carsten Fregin (spielgestalt), Pracherdamm 106, 25436 Tornesch, Germany (see Impressum for contact details).
2. Description of the service
The app helps you log meals, activities, and body weight, and calculates a calorie target. Calorie and nutrient values for photos or text descriptions are produced using an AI estimate (Google Gemini) and may differ from actual values.
3. Not medical advice
The app does not replace medical, nutritional, or psychological advice. The calculated values (basal metabolic rate, calorie target, timeline estimates) are rough guidance based on general rules of thumb (including the Mifflin-St-Jeor formula) and do not account for individual medical circumstances.
Talk to a doctor before changing your diet or starting a weight-loss effort, especially if you have a pre-existing condition, are pregnant, or have (or are prone to) an eating disorder. The app is not designed for use by people with a diagnosed eating disorder.
4. Account and minimum age
Using the app requires an account. You are responsible for keeping your credentials confidential. The app is not directed at persons under 16 years of age.
5. Your content
You are responsible for photos, text, and other content you upload. Do not upload content you don't hold rights to, or that infringes the rights of third parties.
6. Availability
The app is operated with reasonable care, but no entitlement to continuous availability exists. Individual features (in particular the AI estimate) depend on third-party providers and may be temporarily limited.
7. Liability
Statutory liability applies. For simple negligence, liability is limited to breaches of material contractual obligations (cardinal obligations) and capped at foreseeable, typical damage. Liability for intent, gross negligence, and damage to life, body, or health remains unaffected.
8. Termination / account deletion
You can have your account deleted at any time via the app (Profile → Delete account) or by email; use of the app ends immediately.
9. Changes
For material changes to these terms, you will be asked for renewed consent.
10. Governing law
German law applies. Mandatory consumer-protection provisions of your habitual residence remain unaffected.
